Recently, we joined forces with our friends at Crafty Counsel and were lucky enough to run a workshop at their summer event – Crafty Fest. The aim of the workshop was to give attendees a framework for decision-making around what to do and crucially, what not to do. The Employment Rights (Amendment, Revocation and Transitional Provision) Regulations 2023, coming into force on 1 July 2024, bring in some changes to TUPE.Currently, businesses with fewer than ten employees may inform and consult affected employees directly, but larger businesses must arrange elections for affected employees to elect new employee representatives if they are not already in place. The Regulations will remove the requirement to elect employee representatives for the purpose of TUPE consultation for:* Businesses with fewer than 50 employees; and* Businesses of any size involved in a transfer of fewer than ten employees. No other changes are being proposed to the TUPE consultation requirements.
